Terms of Service

1. Agreement
These Terms govern your use of Shopka, a chat-first AI assistant that helps you track your personal spending. By using the service you agree to these Terms. If you do not agree, please do not use the service.
2. Service description
Shopka reads receipts you forward to it, categorises the items, and returns spending analytics. You can optionally share selected purchases with a family group. The service is currently provided free of charge in its current scope.
3. Eligibility
You must be at least 16 years old to use the service.
4. Account
You access Shopka through a supported messaging channel (currently Telegram). Your account is identified by your channel user ID. You are responsible for maintaining the security of the underlying messenger account.
5. Acceptable use
You agree not to:
- send unlawful, harmful, fraudulent, or infringing content;
- attempt to disrupt the service, bypass rate limits, or reverse-engineer the system;
- impersonate another person or misrepresent your identity;
- extract, scrape, or otherwise access data belonging to other users.
6. Intellectual property
The Shopka name, logo, software, and design are owned by us. You retain ownership of the content you submit (receipts, notes). You grant us a limited, non-exclusive, worldwide, royalty-free licence to process that content solely for the purpose of providing the service to you.
7. Disclaimers
The service is provided "as is" and "as available". We make no guarantees about the accuracy of automated categorisation or the uninterrupted availability of the service. Nothing in these Terms limits your statutory rights as a consumer under EU or national law, including under Directive 2011/83/EU and Directive 2019/770.
8. Liability
To the extent permitted by applicable law, our liability is limited to direct damages caused by our intent or gross negligence. Liability for personal injury, fraud, or other matters that cannot be limited under EU consumer law is not affected. Statutory rights of EU consumers, including under Directive 2011/83/EU, remain fully reserved.
9. Right of withdrawal
The service is provided free of charge, so the 14-day withdrawal right under Directive 2011/83/EU applicable to distance contracts for paid services does not apply. You may stop using the service at any time and delete your account.
10. Termination
You may delete your account at any time by contacting support@shopka.app. We may suspend or terminate your access for material breach of these Terms after reasonable notice (which may be shorter or omitted where necessary for security or where the breach is wilful and serious).
11. Changes to these Terms
We may update these Terms. Material changes are notified at least 30 days in advance through the service or by another reasonable channel. Continued use after the effective date constitutes acceptance.
12. Governing law and jurisdiction
These Terms are governed by the law of the country where the service operator is established. EU consumers retain the mandatory protections of the law of their country of habitual residence under Art. 6 of Regulation (EC) No 593/2008 (Rome I), and may bring proceedings in the courts of that country under Art. 18 of Regulation (EU) No 1215/2012 (Brussels I bis).
13. Online dispute resolution
The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not currently obliged to use, and do not commit to, a specific alternative dispute resolution body, but consumer rights to use available ADR schemes are not affected.
